Refund Policy

1. Overview
This Refund Policy governs subscription fees and management charges assessed by ARK Capital Inc. (“ARK Capital,” “we,” “us”) to clients of the ARK Capital investment platform. This policy is effective as of June 1, 2024 and applies to all new and existing subscribers from that date forward.
By subscribing to any ARK Capital plan, you agree to the terms set out in this document. We encourage you to read it carefully before making any payment. If you have questions, contact our billing team before completing a purchase.
2. Subscription Cancellations
You may cancel your ARK Capital subscription at any time by navigating to Dashboard → Billing → Manage Subscription and selecting “Cancel Plan.” No cancellation fees apply.
Cancellations take effect at the end of your current billing period. You will retain full access to all platform features until that date. We do not issue partial or pro-rata refunds for any unused days remaining in a billing cycle that has already been charged.
If you cancel a monthly plan on day 10 of a 30-day cycle, you will continue to have access for the remaining 20 days but will not receive a refund for that period.
3. 7-Day Money-Back Guarantee
New subscribers are eligible for a full refund of their first subscription payment under our 7-Day Money-Back Guarantee, subject to the following conditions:
- The refund request must be submitted within 7 calendar days of the initial charge.
- The guarantee applies to first-time subscribers only — it does not apply to plan upgrades, renewals, or returning subscribers.
- Refund requests must be submitted via a support ticket at Dashboard → Support → New Ticket, with the subject line “Refund Request — Money-Back Guarantee.”
- Approved refunds are returned to the original payment method within 5–10 business days.
4. Management Fees
ARK Capital charges an annual management fee of 0.75% of assets under management (AUM), deducted quarterly from your portfolio. Once a management fee has been deducted, it is final and non-refundable, regardless of subsequent account closure or portfolio performance.
Management fees are calculated based on the average daily portfolio balance during the billing quarter and are disclosed on your quarterly statement. No exceptions to this policy will be made except where required by applicable law.
5. Performance Fees
Where applicable, ARK Capital charges a performance fee based on returns exceeding a defined benchmark (high-water mark). Performance fees are charged at the end of each performance period and are non-refundable once earned, regardless of subsequent drawdowns or account termination.
The specific performance fee rate and benchmark applicable to your account are defined in your Investment Management Agreement (IMA). Please review your IMA for full details.
6. Exceptional Circumstances
ARK Capital recognises that exceptional circumstances may occasionally warrant consideration outside the standard policy:
- Platform Downtime: If the ARK Capital platform experiences verified downtime exceeding 24 consecutive hours due to causes within our control, affected subscribers will receive a pro-rata service credit applied to their next billing period. Credits are not transferable or redeemable for cash.
- Technical Errors: If a billing error or technical fault on our part results in an incorrect charge, we will investigate and, if confirmed, issue a full correction or refund of the erroneous amount within 10 business days.
Exceptional refund requests must be submitted to billing@arkcapital.com with supporting documentation. Each case is reviewed individually and ARK Capital reserves the right to make the final determination.
7. Withdrawal of Capital
The withdrawal of invested capital from your ARK Capital portfolio is governed by our Withdrawal Policy and is not considered a “refund” under this policy. Capital withdrawals are processed within 1–3 business days under normal market conditions, subject to settlement timelines of underlying instruments.
No penalties or early-exit fees apply to capital withdrawals. Any accrued management fees up to the date of withdrawal will be calculated and deducted before funds are remitted. For full details, please refer to the Withdrawal Policy in your client agreement.
8. How to Request a Refund
To submit a refund request, use either of the following methods:
- Email: Send a request to billing@arkcapital.com with your full name, registered email address, transaction date, amount, and reason for the request.
- Support Ticket: Navigate to Dashboard → Support → New Ticketand select “Billing & Refunds” as the category.
We aim to acknowledge all refund requests within 2 business days and to resolve eligible requests within 10 business days of acknowledgement. You will be notified of the outcome via the email address registered to your account.
