1. Acceptance of Terms
By accessing or using Ark Capital's platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use our services.
2. Eligibility
You must be at least 18 years old and legally able to enter into contracts in your jurisdiction. Some products (ARK Private) are available only to accredited investors as defined by applicable securities law. You are responsible for ensuring you meet eligibility requirements before investing.
3. Investment Risk Disclosure
All investments carry risk. Past performance does not guarantee future results. The value of your investments can go down as well as up, and you may receive back less than you invest. Target returns displayed on our platform are illustrative projections, not guarantees. ARK Vision™ is a technology tool and does not constitute personalised financial advice.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. You must not share your account or use another person's account without authorisation.
5. Fees
Our fee schedule is published in your account dashboard and may be updated with 30 days' notice. Fees are deducted monthly from your account balance. By continuing to use the service after a fee change notification, you accept the revised fees.
6. Withdrawals and Liquidity
Withdrawal requests are processed within 1–3 business days, subject to market settlement cycles. In extreme market conditions or regulatory requirements, we reserve the right to delay withdrawals. We will communicate any such delays promptly.
7. Prohibited Activities
You may not use our platform for money laundering or terrorist financing; market manipulation; providing false KYC information; accessing the platform via automated means without our permission; or any activity that violates applicable laws.
8. Intellectual Property
ARK Vision™, Ark Capital, and all associated logos, trademarks, and platform technology are the exclusive property of Ark Capital Inc. You may not reproduce, distribute, or create derivative works without our express written permission.
9. Limitation of Liability
To the maximum extent permitted by law, Ark Capital shall not be liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability in any 12-month period shall not exceed the fees you paid us in that period.
10. Governing Law
These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved by binding arbitration in San Francisco, California, except where prohibited by law.
